Participation Guidelines

• Access: The Creditex platform is open to eligible counterparties and professional clients as defined by the MiFID implementing directive with domestic regulatory approval to deal as principal or agent; Creditex’s services are not available to retail customers.

• Clearing and settlement: The Creditex platform does not provide a clearing and settlement facility for its participants. It is the responsibility of the participant to make proprietary arrangements to clear and settle their transactions through a central settlement venue or bilaterally with their counterparties.

• Instruments: The platform currently facilitates the conclusion of transactions of credit derivative instruments and corporate bonds pursuant to MiFID Implementing Directive Annex 1 Sections C (1) (4) and (8).

• Fair and orderly trading: Users are required to observe the relevant participation agreements to which they have subscribed which dictate their obligations to Creditex and their counterparties. Participation is regularly monitored to ensure participants are meeting these requirements.

In order to comply with applicable laws, rules and regulations, all credit derivative-related services (including the electronic trading of credit default swaps) for Creditex platform participants in Australia shall be provided and operated by Creditex Brokerage LLP (ARBN 134 638 734). Additionally, no portion of the Creditex platform, other than credit derivatives-related services, shall be provided to platform participants in Australia.
